OMAHA, Neb. (AP) ? The Michael Phelps and Ryan Lochte Show is down to its last act at the U.S. Olympic trials.
The world's two best swimmers go at it in the 200-meter individual medley starting with preliminaries on Friday morning. So far, they are 1-1 against each other in thrilling races.
Lochte won their first showdown in the 400 IM on opening night. Then Phelps got revenge by winning the 200 freestyle on Wednesday.
The 200 IM is up for grabs.
Lochte beat Phelps in the event at last year's world championships in Shanghai while setting the first world record since high-tech body suits were banned. But the Floridian also has to swim the prelims and semifinals of the 200 backstroke ? he is the world champ in it ? on Friday, while Phelps only has one event.
"I have a hard double tomorrow," he said.
Lochte scratched the 100 freestyle final on Friday night to ease his schedule and focus on his stronger events. Matt Grevers also scratched, and their moves opened up spots in the eight-man final for Jason Lezak and Dave Walters. Lezak saved Phelps' bid for eight gold medals in Beijing with his anchor leg of the 400 free relay.
"He better owe me something," Lochte joked when asked about giving Lezak another chance to get back to the Olympics at 36.
The 100 free is loaded with Olympic medalists like Lezak, Nathan Adrian, Ricky Berens, Cullen Jones and Garrett Weber-Gale.
While Lochte advanced through the prelims and semis of the 100 free before bowing out, Phelps scratched the event altogether so he could steal a rare morning off. He spent part of Thursday in his hotel watching "Act of Valor" and ordering room service with training partner Allison Schmitt.
"We were able to just sit around and tell jokes," he said.
In the evening, he returned to the pool and easily won the 200 butterfly, his signature event and a favorite of his family since his two older sisters used to swim it, too.
"Very relaxing day. And yeah, I think it showed in the race," Phelps said. "I was comfortable. That was something that just helped everything, and hopefully will carry through the rest of the meet."
Phelps took the lead on the third lap and he finished a body length ahead of the field in 1 minute, 53.65 seconds, his easiest final yet in Omaha.
Phelps said he will have to go even faster in London to claim his third straight gold in the 200 fly.
"It's not a good enough time to win a gold medal, but I think I'm OK with it," he said. "Going into the last wall. I didn't want to have any close ones, so I tried to stay under as long as I could. Today was the best my stroke has felt throughout the whole meet."
Phelps' biggest challenge came at the end of the night when he visited the news conference room, where the air conditioning was cranked and cold air was blowing.
"Sorry, I can't even think right now, it's freezing in this place. Holy crap," he said, his arms wrapped around his shivering body, "and I just got out of a 48-degree ice bath."
Phelps' victory locked up his third individual event for the London Games, and he's got the 200 IM and 100 butterfly left in Omaha. That sets him up to swim eight events at the Olympics, including a likely spot on all three relays, and gives him a chance to duplicate his record from the Beijing Games.
On Friday, Eric Shanteau and Brendan Hansen are the favorites in the 200 breaststroke final, although Clark Burckle goes in with the fastest qualifying time. Teresa Crippen, sister of the late open-water swimmer Fran Crippen, has a shot at making the Olympic team in the 200 butterfly final.
The other Olympic berth in the 200 fly went to Tyler Clary, who finished second with a time of 1:55.12 on Thursday.
"It was amazing," Clary said. "I can't even put into words how the end of that race felt, not only the pain in the last 20 meters but just the complete and total turnaround."
Phelps' pal Schmitt was equally dominating in winning the 200 free. She broke her own American record with a time of 1:54.40, the best in the world this year. She had already won the 400 free here.
"I didn't feel like I was on my record pace, but I could hear the crowd," Schmitt said. "And when I touched and saw the flames go off I was pretty excited before I even looked up and saw the time."
Seventeen-year-old Missy Franklin locked up another Olympic race, claiming the second 200 spot in 1:56.79. She rallied from fifth place at the first turn.
Franklin already won the 100 backstroke and looks poised to have another huge performance in London, after breaking through at last year's worlds with five medals.
Dana Vollmer and Lauren Perdue finished third and fourth, assuring themselves of being in the pool for the 800 free relay. Shannon Vreeland (fifth) and Alyssa Anderson (sixth) also are likely to be taken to London as potential relay swimmers.
Caitlin Leverenz became a first-time Olympian with a victory in the 200 IM. She was dominating on the final two legs ? breaststroke and freestyle ? and pulled away to win in 2:10.22.
Ariana Kukors, who won gold in the event at the 2009 world championships and was third at last year's worlds, rallied to claim a spot on her first Olympic team, as well. She touched second in 2:11.30, just 25-hundredths ahead of Elizabeth Pelton, who led the first two laps but couldn't hang on.

Linens retailer headed to hall of fame
It's been quite a week for Bob Ianson.
The co-owner of Heirloom Linens in Broadmead Village celebrated the 17th anniversary of the business with his wife, Joan. The couple's daughter delivered their first grandchild. The business donated $4,000 to Victoria Hospice through its annual garage sale event.
And now Ianson is being inducted into the Canadian Retail Hall of Fame.
"I haven't had time to catch my breath," Ianson said.
Ianson was one of eight independent retailers from across Canada to receive the Retail Council of Canada's highest honour.
Normally reserved for founders and CEOs of big corporate stores, this year's induction marks a significant shift to honour small businesses which, when combined, are some of the biggest economic generators and employers in Canada.
The Retail Council and several small business organizations in Canada, including Shelf Space in B.C. and Alberta, are in the process of merging. Ianson and the other inductees were part of a task force formed to study the merger on behalf of independent businesses.
"The Retail Council has usually focused its attention on the big players and larger stores, but they are seeing the importance of the smaller independents," said Ianson.
"It's a huge honour to get into the council's hall of fame," he added.
Ianson, 57, has spent nearly 40 years in retail - all of it in the bed and bath sector.
He joined Woodward's in 1975 at Mayfair Shopping Centre, working his way up the corporate chain to a buyer with transfers to Vancouver and then Calgary.
With the demise of Woodward's, Ianson was headhunted by Seattle-based Pacific Linens and helped the company set up 10 stores in Canada. After Pacific Linens ran into financial difficulties, Ianson and wife Joan made the decision to go into business for themselves and opened Heirloom Linens in Broadmead Village. "I had enough of companies going broke," said Ianson. "I said at the time 'I could probably do that myself.' "
They opened Heirloom Linens on June 25, 1995, and quickly earned a reputation for quality goods and topnotch service. Their slogan - It Only Sounds Expensive - was testament to the couple's strong buying channels and loyal following.
"We've always treated our customers well" through quality products and service, said Ianson. "Staff have a broad product knowledge and our return policy is like that of the big stores. If you don't like it when you get it home or made a wrong measurement for sheets, bring it back."
Returned items are resold at Heirloom Linen's annual garage sale fundraising event.
This month, the company turned over $4,000 to the Victoria Hospice. Last year, more than $7,000 was raised for Jeneece Place for visiting families of children needing medical care at Victoria General Hospital.
"We enjoy the business and we enjoy satisfied customers," said Ianson, who celebrates his 35th anniversary with Joan this year.
"On behalf of the retail industry we are proud to honour this outstanding group of retailers for their vision and commitment to entrepreneurship," Diane Brisebois, president and CEO of the Retail Council, said in a statement. "As members of the council's Independent Retailer Task Force, this group enabled us to chart a course that, at its core, focused on providing community involvement, leadership development and lifelong learning opportunities for independent retailers and their employees across Canada."

Even before the ACA was passed in March of 2010, I had been arguing to anyone who would listen that the simplest way to justify the individual mandate was as a tax under the General Welfare Clause. I continued to make the arguments in front of any number of audiences, most of whom just wanted to hear about broccoli.
The case?s ultimate result did not surprise me. If the Commerce Clause argument couldn't command five votes, the tax power argument was always waiting in the wings. As soon as members of the court saw the individual mandate as a tax, they would almost certainly hold it constitutional. The biggest challenge was getting five of them to see it as a tax.
There were a number of obstacles standing in the way of that conclusion. The first was the strategy of the mandate opponents, who, from the outset, wanted to fight exclusively about the scope of the Commerce Clause. The second was President Obama and the Democrats in Congress, who were desperate to avoid any suggestion that they had created new taxes. The third was the Tax Anti-Injunction Act. If the mandate were a tax under the meaning of the TAIA, that would prevent any court from hearing a challenge until around 2015. The mandate opponents were not the only ones interested in a quick resolution: The Obama Administration needed to implement the many different moving parts of the Affordable Care Act in the states, and it didn't want to see the act laboring under a cloud of suspicion for many years.
The fourth obstacle, frankly, was that the tax argument seemed like a fifth wheel. Any federal district judge who thought the mandate was a constitutional?tax probably also thought it was constitutional under the commerce power, and any federal district judge who thought it wasn't constitutional under the commerce power probably wasn't going to uphold it as a tax.
As a result of all these factors, almost nobody wanted to think about the mandate as a tax. (Well almost nobody. The Justice Department dutifully included the tax-power argument throughout the litigation, and I was part of an amicus team who worked specifically on tax power issues.) Depending on their ideological priors, federal courts seemed eager either to uphold the ACA or strike it down. As a result, almost all of them concluded that the mandate was not a tax?thus avoiding the obstacle of the Tax Anti-Injunction Act?and letting them move on to what everybody thought was the main event, the debate over the Commerce Clause.
Most of the coverage in the press focused on the Commerce Clause, too. Debate after debate focused relentlessly on only one ground for upholding the mandate. For the supporters of the ACA, this was pretty much like fighting a wily opponent with one hand tied behind your back. Even if you win, you are going to get bruised and battered in the process.
Essentially, the entire debate over the Affordable Care Act was played out on the turf most favorable to mandate opponents. And with an entire political party and its associated media behind the opponents' arguments, conventional wisdom quickly changed to reflect the growing view that the act would fall.
Once the case made its way to the Supreme Court, however, the calculations changed.? Here it was entirely possible that either Chief Justice John Roberts or Justice Anthony Kennedy, or both, might accept the tax-power argument as a lifeline because they couldn't stomach the Commerce Clause argument. Solicitor General Donald Verrilli?improperly maligned by people who should have known better?carefully organized both the government?s briefs and his oral argument to make the tax-power option clearly available to Kennedy and Roberts.
At that point, the question became ?whether either justice would form a five-person coalition with the liberals. Roberts ultimately did so, but his motivations are complicated.
Roberts' opinion on the tax-power issue is straightforward doctrinally. But he also got to create a five-person majority (with the four dissenters) sticking a knife in the back of the Commerce Clause argument. He got to play John Marshall in Marbury v. Madison, giving the Democrats a bottom-line political result they wanted while vindicating conservative arguments against the mandate in his opinion.
Subject to important qualifications noted below, this may turn out to be yet another exercise in symbolic federalism. If the argument about the Commerce Clause isn't dicta, it will have very little effect on what Congress does going forward, because Congress can now use the tax power instead of the commerce power. The specter of vegetables still haunts us. We may be safe from broccoli mandates, but we are not safe from broccoli taxes.???
Second, Roberts opened up a brand new field for constitutional litigation about conditional federal spending programs like Medicaid. The decision says that when Congress threatens to withhold funding for program A unless states agree to program B, this can be coercive if the costs of exit from A and the reliance interest in A are too high.?
In this case, Roberts argued that Old Medicaid, which protects mostly disabled and the elderly poor, is a different program than New Medicaid, which reaches everyone up to 133 percent of the poverty line. Congress cannot say to the states: "Participate in New Medicaid or we'll pull funding from Old Medicaid."
The logic of this argument depends on a court knowing that Old Medicaid is really different in kind and not merely in degree from New Medicaid. Why Congress isn't the best judge of whether the two programs are different in kind is a mystery to me. (It would also probably come as a surprise to Congress, which had changed the program's eligibility requirements before.)
It's that conclusion that will cause lots of work for lawyers going forward. (And it?s also great for authors of constitutional law textbooks like yours truly!) I will be interested to see if the same logic is used to challenge changes in conditional spending programs that conservatives favor. (Consider the Welfare Reform Act of 1996 as an example. Indeed, perhaps there are parts of the proposed Paul Ryan budget that might be vulnerable, although I haven't inspected it closely enough to tell.)
I'm also wondering what becomes of laws that threaten to withhold federal funding from all of a state's operations if the state refuses to acquiesce on a federal policy that only affects a small or distinct aspect of its operations. Is that akin to removing funding from program A because you won't play ball on program B? The Solomon Amendment, I seem to recall, withheld funding for state and private universities if their law schools did not admit military recruiters on an equal basis with other recruiters. Does the logic of this case apply to that? Does it apply to civil rights laws like Title VI and Title IX? To be sure, these cases seem distinguishable in several ways, and there is language in the various opinions that suggests that the principle will not be extended so far. Yet Chief Justice Roberts has opened the proverbial can of worms, and nobody knows where those worms will squiggle once they are loosed upon the world.
It's hard to predict what will flow from this opinion doctrinally. If President Obama manages to appoint a majority of liberal justices in his second term, most of the innovations in this case will be forgotten.? The new spending clause doctrines will be confined, and the Commerce Clause language treated as dicta or made practically irrelevant. If Mitt Romney wins, on the other hand, he may be able to appoint a strong conservative majority to work with Chief Justice Roberts. Then, in hindsight, Roberts' seemingly compromised opinion won't be very compromised at all. His apparent flip-flop won't be understood as a change of mind. Instead, his opinion may turn out, in hindsight, to be the beginning of an important transformation in constitutional law. What will happen can't be deduced from the four corners of these documents. It will depend on the Supreme Court appointments of the next decade.

Spice Girls 'Viva Forever!' Musical: Five Must-Hear Tracks
MTV News picks the pop ballads we most want to hear when the Spice Girls musical hits the stage.

The Spice Girls — all five of them — appeared in London on Tuesday to announce "Viva Forever!," a musical based on their career and music, named after their 1997 single.
The girls gathered on the stairs of the St. Pancras Renaissance Hotel, 16 years after they shot their star-making "Wannabe" video there. With "Mamma Mia!" producer Judy Craymer and "Absolutely Fabulous" star Jennifer Saunders collaborating on the project, this jukebox musical, according to the ladies, will "embrace all generations."
This is hardly the first time that the ladies have used their rise to fame as the basis for a piece of semi-fiction. They spoofed their pop superstardom in the 1997 comedy "Spice World." And, while it was a landmark event to see all five of the Spice Girls in one place on Tuesday, they also reunited for a massive world tour in 2007.
In an interview with the BBC at the event, the Spice Girls themselves seemed excited to have their music, which focused quite frequently on themes of female empowerment, hitting the stage for a new crop of young people to hear. Posh Spice herself, Victoria Beckham, added, "We're going to be introducing a whole new generation to Girl Power."

So, when it comes to a musical based on the music of the peace sign-making, platform shoe-wearing, brassy fivesome, there's an endless number of tracks that can be plucked from their catalog to include in the show. So, MTV News is pitching our five favorite (and in our opinion definitive) tracks that we hope make the final cut of the show.
"Wannabe"
This is the track that introduced the world to the Spice Girls. Off their 1996 debut, Spice, the cheeky song reminded any potential love interests that "If you wannabe my lover, you got to get with my friends." Not only did it launch the ladies to pop fame, it also made the term "zigazig-ha" a perplexing, must sing-along-to lyric.
"Say You'll Be There"
Also off Spice, this track, which spawned our favorite SG video of all time thanks to its overt references to "Faster, Pussycat! Kill! Kill!," picked up where "Wannabe" left off, reminding girls everywhere that just because a guy really likes you doesn't mean you have to commit to him. Girl power, indeed.
"Spice Up Your Life"
One year after dropping their debut, the ladies were still riding high off instant mega-fame and released 1997's Spice World. "Spice Up Your Life" was all about throwing caution to the wind no matter your race or gender, with the ladies proudly proclaiming, "Colors of the world/ Spice up your life/ Every boy and every girl/ Spice up your life." With congos and Latin music influencing the sound of the track (and everything that year), "Spice" was an anthem that proved their music can just make you dance, or merengue.
"Stop"
"Stop right now/Thank you very much/I need somebody with a human touch." While we're still not exactly sure what that means — unless, of course the ladies had been romanced by robots 8212; we get where the girls are coming from on this 1998 single about guys who just can't quit playing games with their hearts.
"Too Much"
The girl group slowed it down in '98 for this awesome ballad where the five ladies have some choice words for any guy who thinks it's going to be easy to woo the Spice Girls. ?There are simply too many rules, laws, and regulations which prevent small business owners from going to the next step, expanding their business, getting a business loan, or hiring more employees. If we really want to deal with our unemployment situation, increase innovation, and get this economy firing on all cylinders again then we need to be thinking here ? so let?s go ahead and talk about that for a moment if we might.
The other day, someone contacted me at our think tank with a revolutionary business idea ? it was a new invention in the alternative energy sector. Now most of these eco-innovations aren?t really that efficient, and they are merely trying to capitalize on the environmental movement and trend. However this one was quite good, and yet this entrepreneur was so worried about all the licenses, rules, and where to hire a lawyer, accountant, and consultant or business coach to help him through the myriad or maze of prerequisites ? that he was literally afraid to start.
He was looking for someone to give him permission so that he can go out and create this new invention for the marketplace, sell it, and pursue his passion. The reality is you don?t need permission in the United States of America to go out and do great things. Unfortunately, far too many people have their brain stuck in a box, and they have been indoctrinated by authoritarian systems ? and that?s a real problem. Let me put it this way; you don?t need permission to go and do great things in this life, or pursue your happiness.
But, if you still believe you do, then I hereby give you permission to go out and do your life?s work with all the passion and vigor you can muster. What I?m saying is; it?s time to go out and do it, and figure out the rest as you go along. Yes, there will be some rules and regulations and hoops that you must jump through, and you do have to follow the law, but most importantly, you need to act, and get started. If you wait until everything is perfect, and you have all the permission you need, you?ll never do anything in your life.
Now wouldn?t that be a travesty? You know, sometimes you just got a get out there and get it done. Indeed I hope you will please consider all this and think on it.

The VCStar tells us from Ventura County, California a rent increase at an MHC has triggered a lawsuit by residents challenging the Thousand Oaks City Council?s decision of last year to remove the age and income restriction agreement for determining site rents and instead place that authority under the auspices of the revised rent stabilization board. Residents of Ranch Mobile Home Park currently pay an average of $132/mth, but under the new agreement rent will rise $191.95 over seven years. Average site rent in other MHCs in Thousand Oaks is $450/mth. Ranch residents contend in the lawsuit the increase will be more than they can afford because they are seniors on fixed incomes, and have asked a judge to reinstate the income and age restriction. The original agreement between MHC owners and residents was welcomed as fair by most other MHC residents, but Ranch representatives walked out of the mediation meetings. MHProNews has learned the rent restrictions have been in effect since 1977.

Family and fans took to Twitter Monday morning to share their sentiments about the late King of Pop on the third anniversary of his death.
Michael Jackson's fans haven't forgotten him. And neither has the King of Pop's little princess.
Early Monday morning, on the third anniversary of the music icon's death, Paris Jackson took to Twitter to pay tribute to her father's memory.

"RIP Michael Jackson," she wrote. "Dad you will be forever in my heart. I love you."
Earlier, she retweeted a message sent her way, reading, "The ones that love us never really leave us. You can always find them in here *heart*."
Unsurprisingly, Paris wasn't alone in paying tribute to her dad, as "RIP Michael Jackson" has been trending on Twitter all morning, with Michael's siblings also speaking out.

"3 yrs ago on this June 25th, my brother passed," Randy Jackson tweeted, adding that he planned on visiting Forest Lawn, where Michael is buried, later today.

Angela Merkel deflects attempts to agree to additional Euro debt
ROME??German Chancellor Angela Merkel on Friday parried attempts to get her to accept more flexibility for the euro-region's rescue funds, while agreeing with leaders of Italy, Spain and France on an outline to spur economic growth.
At a four-way summit meeting in Rome, Merkel, Italian Prime Minister Mario Monti, French President Francois Hollande and Spanish Prime Minister Mariano Rajoy said they would lobby their European Union partners to accept a growth plan of as much as $163 billion, or about 1 percent of the euro-region's economic output.
With pressure mounting on Merkel to relent on her rejection of additional joint debt burdens, European leaders are looking to focus on growth as a way out of a sovereign debt crisis now in its third year. They are racing to come up with a plan to salvage the monetary union by a summit in Brussels next week, the fourth such make-or-break meeting this year, as concerns over Spain's banks and flagging growth across the bloc shake investor confidence.
"We want to make clear that we're going to do everything to fight for the euro," Merkel told reporters at the Villa Madama in Rome."We need to approach the issues of growth and employment for people more strongly after having already intensively pursued the issue of consolidation."In an interview Friday with a group of European newspapers including Le Monde and El Pais, Monti said the weeklong run up to the summit may prove critical to the survival of the euro.

South Carolina's win over Arkansas on Friday caps off a thrilling run of three straight do-or-die wins for the resilient Gamecocks. The Wildcats will be hoping their resilience has limits as the two teams meet up starting on Sunday for a best two-of-three series to determine a national NCAA champion.
The first game of the finals will take place on Sunday at 5:00 p.m. PT and will be televised on ESPN 2.

Texas GOP Senate Debate
Republican candidates Ted Cruz and David Dewhurst participate in their first televised debate at a Texas Public Television Station.
The candidates are scheduled for a run-off election on July 31, after neither candidate reached the 50 percent threshold in the May 30 primary.
The battle between the two candidates is being viewed as an example of the larger fight in the Republican party over the past few years between the party establishment, represented by Lieutenant Governor Dewhurst, and the offshoot Tea Party wing, which has supported Mr. Cruz, a former Texas Solicitor General.
The debate will be moderated by a panel of journalists from across Texas, and a studio audience of voters will also be allowed to participate.
